This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity, "User" or "you") and Horizon Tech Development, LLC ("Licensor," "we," "us," or "our") for the software applications published by Horizon Tech Development, LLC, including but not limited to ContractorApp, Brass & Powder, and RiderRadar (collectively, the "Software" or "Apps").
By installing, copying, or otherwise using any of our Apps, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
Horizon Tech Development, LLC grants you a limited, non-exclusive, non-transferable license to install and use the Software on your personal devices, subject to the following conditions:

The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.
All title and intellectual property rights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software) are owned by Horizon Tech Development, LLC or its suppliers.
You acknowledge that no title to the intellectual property in the Software is transferred to you. You acquire only the right to use the Software and do not acquire any rights of ownership.
You own all data you create, input, or generate using the Software. Horizon Tech Development, LLC does not claim any ownership rights over your data.

We may, from time to time, provide updates, upgrades, or patches to the Software ("Updates"). Such Updates may be provided automatically through app store mechanisms or within the app itself.
Updates may be required to continue using the Software. We are not obligated to provide any Updates. If we provide Updates, they are subject to this EULA unless accompanied by a separate license.
We may discontinue support for older versions of the Software. We will provide reasonable notice before discontinuing support for a major version.
The Software may include third-party components (open source libraries, frameworks, or other software) that are subject to their own license terms. Such third-party licenses are incorporated by reference into this EULA.
A list of third-party components and their licenses is available within the Software's settings or upon request.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
IN NO EVENT SHALL HORIZON TECH DEVELOPMENT, LLC OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF HORIZON TECH DEVELOPMENT, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. FOR FREE SOFTWARE, OUR LIABILITY SHALL BE LIMITED TO US$1.00.
This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this EULA.
Upon termination, you must destroy all copies of the Software in your possession.
For subscription-based Software, termination of your subscription results in termination of this license. You may lose access to certain features or data upon termination.
This EULA shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
You agree to comply with all applicable export and import laws and regulations. You will not export or re-export the Software in violation of any applicable laws or regulations, or without all required licenses and authorizations.
If the Software is acquired by or on behalf of a unit or agency of the United States Government, the Software is commercial computer software and the documentation is commercial computer software documentation. Use, duplication, or disclosure is subject to the restrictions set forth in this EULA.
You agree to indemnify, defend, and hold harmless Horizon Tech Development, LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This EULA, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between you and Horizon Tech Development, LLC relating to the Software and supersedes all prior or contemporaneous oral or written agreements.
